These terms apply to use of www.lengausociety.co.za and related Lengau People's Society channels.

Nothing in these Terms limits any right, remedy, warranty or protection that applicable law does not permit Lengau to exclude, restrict or waive.

These Terms never override South African law. Where a provision conflicts with applicable law, the law takes precedence.

1. Introduction

Lengau People's Society ("Lengau", "we", "us") is a community economic development organisation. These Terms govern access to this website and, where relevant, applications, membership communications, product information and related services. They must be read with the Member Agreement, Consumer Protection page, Privacy Policy, Responsible Lending information and any product-specific terms that apply to a particular transaction.

2. Definitions

"Member" means a person whose membership has been accepted in accordance with Lengau's governing documents. "Consumer" means a person acquiring goods or services as a consumer under applicable law. "Website" means lengausociety.co.za and related official pages. "Credit" means credit or lending activity only where Lengau is authorised and the National Credit Act applies to that activity. These Terms do not treat membership, donations, purchases and credit as the same thing.

3. Website use

You may use the website for lawful purposes. You must not attempt to disrupt, scrape in an abusive manner, impersonate Lengau, or publish false information about Lengau, its members or its products.

4. Eligibility

You must have legal capacity to enter into the relevant arrangement. Additional eligibility rules may apply to membership, credit and certain programmes and will be stated in the applicable application or agreement.

5. Membership

Membership is subject to application, assessment and Lengau's constitution and approved policies. Membership is not a bank account, not an investment scheme and does not, by itself, guarantee funding, profit or a particular financial outcome. See the Member Agreement.

6. Applications and approvals

Submitting an application (membership, business support, credit, distribution or otherwise) does not create an approval. Lengau may request further information, decline an application, or approve subject to conditions, in accordance with applicable law and its policies.

7. Products and services

Product descriptions on the website are information. The information printed on packaging, invoices, quotations and signed agreements prevails where there is a difference. Lengau Maize Meal and other goods are supplied subject to applicable consumer and food-labelling law. See Lengau Maize Meal and Consumer Protection.

8. Lending and credit

Where Lengau provides credit, it does so as a registered credit provider (NCRCP22999) and subject to the National Credit Act and related rules, as applicable to that transaction. Website content about responsible lending is not itself a credit agreement. See Responsible Lending and lending information.

9. Marketplace activities

Listings on the Lengau Marketplace may be posted by members or third parties. Lengau is not automatically a party to every marketplace sale. Users must not post unlawful, misleading or infringing content. Lengau may remove listings that appear to breach these Terms or applicable law.

10. Pricing

Prices, where published, should be current and not misleading. If a price is stated as "contact for bulk pricing" or similar, no specific rand amount is being advertised. Different prices in different regions require a clear business reason. See the Prosperity Charter on transparent pricing.

11. Payments

Payments may be membership contributions, donations, purchases, credit-related payments, optional service fees or other amounts. Each category must be identified clearly. A compulsory payment must not be described as a donation. See the Donation & Voluntary Contribution Policy.

12. Orders and fulfilment

Goods are supplied subject to availability, agreed quantities, delivery arrangements and the information on packaging and invoices. Risk and ownership pass as provided in the applicable sale terms and South African law.

13. Cancellations and refunds

Cancellations, returns, refunds and other remedies are handled in accordance with applicable South African law (including the CPA where it applies) and Lengau's approved policies. These Terms do not invent a "no questions asked" or fixed-day refund promise.

14. Member responsibilities

Members must provide accurate information, keep contact details current, treat others with dignity, and not misuse Lengau's name, funds or systems.

15. User-generated information

You are responsible for information you submit (forms, marketplace posts, comments). Do not submit another person's personal information without a lawful basis.

16. Intellectual property

Lengau names, logos, site content and document frameworks are protected. You may not copy them for commercial use without written permission, except as allowed by law (for example fair dealing).

17. Privacy

Personal information is processed as described in the Privacy Policy and POPIA page.

18. Fraud and abuse

Lengau may investigate suspected fraud, identity misuse, payment abuse or misrepresentation and may report matters to the police or regulators where appropriate.

19. Prohibited conduct

You may not use Lengau channels for unlawful content, harassment, money-laundering, pyramid schemes, or to promise guaranteed wealth on Lengau's behalf.

20. Third-party services

Links to WhatsApp, social media, payment processors or government sites are provided for convenience. Those providers have their own terms. Lengau is not responsible for third-party sites except as the law requires.

21. Service availability

The website may be unavailable from time to time for maintenance, connectivity or circumstances beyond Lengau's reasonable control.

22. Errors and corrections

Lengau may correct obvious errors in prices, descriptions or documents. Material corrections should be communicated in a fair manner. Outdated prices should not remain published once a current approved price is known.

24. Dispute resolution

Parties should first use Lengau's internal complaints process. Consumers and members may have additional rights to approach the National Consumer Commission, credit ombud structures (where credit is involved), or the courts. Nothing in these Terms requires you to waive a forum that the law preserves.

25. Limitation of liability

To the extent legally permitted, Lengau is not liable for loss that is not reasonably foreseeable, or for loss caused by your breach, third-party systems, or events outside Lengau's reasonable control. This clause does not exclude liability for fraud, gross negligence where the law does not allow exclusion, death or personal injury caused by negligence where such exclusion is not permitted, or any other liability that applicable law does not permit Lengau to exclude or restrict.

26. Indemnity

To the extent legally permitted, you indemnify Lengau against loss arising from your unlawful use of the website, your false statements, or your infringement of third-party rights. This indemnity does not require you to indemnify Lengau for Lengau's own unlawful conduct.

27. Suspension and termination

Lengau may suspend website access or, subject to governing documents and law, membership or programme participation where there is material breach, fraud risk or legal requirement. Statutory and contractual notice rights remain.

28. Governing law

These Terms are governed by the law of the Republic of South Africa. Courts of South Africa have jurisdiction, without limiting any consumer forum that the law provides.

29. Changes to terms

Lengau may update these Terms. Material changes should be indicated on this page. Continued use of the website after publication constitutes notice of the updated Terms for website use. Separate contracts are changed only in accordance with those contracts and the law.
